The FLRA Releases Video on the “CFPB” Management Rights Test

Today, the FLRA’s three-member, decisional component (the Authority) released a training video on the “CFPB test” – the updated test the Authority applies in reviewing management-rights challenges to arbitration awards that find violations of collective-bargaining agreements. The Authority developed the CFPB test in its recent decision, Consumer Financial Protection
Bureau, 73 FLRA 670 (2023).

The video educates federal parties and arbitrators on the elements and application of the CFPB test and explains various arguments parties should make, and arbitrators should address, during the arbitration process and in appeals before the Authority.

The video is posted on FLRA’s YouTube channel, as well as in FLRA’s video training library.
